White-collar crimes and possible remedies in the Indian corporate sector: A study

Abstract:

White-collar crimes in the Indian corporate sector have a profound impact on the economy, politics, and society, encompassing activities such as corruption, bribery, financial scams, and corporate fraud. This study examines the prevalence, characteristics, and consequences of non-violent, financially motivated offenses committed by individuals in positions of authority or influence. This research scrutinizes the regulatory and legal framework in India, including the Companies Act 2013, SEBI regulations, and the Prevention of Money Laundering Act 2002, emphasizing the enforcement challenges posed by the complexity of these crimes. This study identifies deficiencies in corporate governance structures, particularly within family-owned enterprises, that contribute to issues such as pyramiding and tunnelling activities. White-collar crimes result in significant investor losses, market instability, and deterioration of public trust in institutions. Although technological advancements have enabled more sophisticated forms of crime, they have also provided new tools for detection and prevention. The analysis of high-profile cases, such as the Satyam scandal, reveals systemic weaknesses in corporate governance and regulatory oversight, prompting substantial policy changes and reforms. The study concludes that addressing white-collar crimes in India necessitates a multifaceted approach involving legal reforms, technological solutions, improved corporate governance, increased public awareness, and enhanced ethical standards within the corporate sector. Challenges include weak law enforcement, judicial delays, and rapid evolution of technological crimes. Ongoing efforts are essential to fortify prevention and enforcement mechanisms through collaboration between regulatory bodies, corporations, and stakeholders to cultivate a more transparent and accountable business environment in India.
